tonight, a memorial along a busy oakland boulevard where a man was gunned down right in the middle of the day. >> it sounded like a machine gun. we have a serious problem when it comes to crime. >> the family of the victim says he was working when someone fired dozens of shots. good evening, everyone. i'm mike mibach, and i'm betty yu. >> that shooting happened along international boulevard yesterday afternoon. the homicide scene still filled with evidence markers tonight. new at ten ktvu. amber lee is live in oakland after speaking with the victim's family. amber >> betty. i spoke with a relative who visited the crime scene this afternoon. he declined to speak on camera, but did share some details about the victim. the killing took place in a busy parking lot. >> a memorial of candles and flowers marks the site where a man was shot, and killed here in

east oakland while working. >> a family member identified the victim as william robinson, a graduate of oakland high school. the killing took place near a mural that reads heal oakland in the back parking lot of a dollar store. i'm beyond vigilant. >> you just have to be vigilant in general wherever you go. unfortunately, with it being oakland, you just have to be a little more vigilant. >> police say just before 4:00 tuesday afternoon, officers responding to a shooting along international boulevard found a man who had been shot. he died at the scene. we spotted dozens of evidence markers. a business owner nearby says the killing is another example of the violent crime that grips oakland. >> i heard the shots like 25 shots, you know, and i'm across the street and police coming, and somebody died. >> family and neighbors tell me that the 27 year old victim worked under a tent selling cell phone service to low income customers. they say he was out here daily. >> we have a serious crime

problem here, and it's an emergency. and we got to address it. and we need more law enforcement and be able to enforce the laws that we have. >> city council member noel gayo represents this district. he takes issue with other city leaders who quote data showing violent crime is down. >> they don't live in it. they don't touch it. they don't see it. >> gayo says he took this photo when he happened upon the scene shortly after the homicide. he says three suspects fired at the victim. >> they pulled up and shot him and killed him and moved on. >> neighbors say they are unsettled by the many shots fired during this homicide. they say often no law enforcement presence until there is a loss of life. >> every day it is more and more. more people die in the street, you know. you know, it can robbery at that time and police not coming. >> police say they're conducting a follow up investigation into the circ*mstances of this shooting. they have not said what the motive was. investigators are asking anyone with videos or photos of the

incident to contact them. >> betty, it being a busy area. hopefully someone with video or photos comes forward. amberleigh live in oakland. amber. thank you. a person was apparently killed by a bart train at the downtown berkeley station tonight. a bart spokesperson said this happened at about 545 this evening. the person was not on the tracks, but on the platform inside the yellow lines when they were apparently struck. bart says that foul play was not suspected. the downtown berkeley station was closed for a time, but has now reopened. in san francisco, two muni bus drivers were sent to the hospital after their busses crashed in the bayview district. the fire department says this happened at third and palou street just before four this afternoon. police had to conduct traffic control in the area as a tow truck came to remove the bus. the drivers of the two busses suffered minor injuries. >> tonight, a mother is expressing frustration after her

son was attacked right inside the locker room at dublin high school. >> as ktvu jana katsuyama reports, the woman says her 14 year old son suffered serious injuries and she's now demanding action from the school district. >> three barfield says her son dasani, was the dublin high school freshman who was beaten in the school locker room last friday. he's on the jv football team. a photo of him hangs in her restaurant, sherry's southern kitchen, but the severe injuries sent him to the hospital and means he can't play in his first high school game. >> he was diagnosed with a concussion and he had a black eye, and then he had a broken nose. and of course, he's traumatized and they slammed his head into the locker and everything. and that's where the concussion came from. >> barfield says her older son, bryce, got the phone call from another brother who attends the school. bryce says it was a shock when he found dasani and there was just blood everywhere on the floor, so it was sickening to see. >> and then even the fact that they were able to get into the locker room, his whole face was swollen and his eyes were

practically shut, and he was screaming and crying at the top of his lungs. >> he's 14 years old. >> barfield says, according to dasani, he had been in an argument with a female student, and the girl's mother confronted him after school with four attackers wearing hoodies. >> we did determine that there was a parent of a dublin high school student that was on campus there that confronted our victim at some point. we were able to see this on video as well. >> dublin police chief nate schmidt says they are reviewing surveillance video and believe the four attackers are between 16 and 19 years old. >> this is something that was targeted and i truly believe that we will figure out and identify who these subjects are. >> some community members stopped by the restaurant to show support, you know, trying to just be supportive. >> you know, i know there's all children involved. i don't know the whole story, but, you know, violence is not not the way to do to solve anything. >> barfield says she's planning to hold a unity brunch on sunday to raise funds and awareness.

water across the district. the superintendent addressed it for the first time tonight. ktvu baylee o'carroll joins us now. she was at that board meeting. baylee. >> yeah. betty. parents teachers and staff all voicing their concerns over those elevated lead levels in the water across campuses at oakland unified school district. but not just the fact that lead was found in the water. they were also upset about how long it took for the district to make families aware of the issue. parents of students in the oakland unified school district asked at a school board meeting wednesday night why their kids don't have access to clean drinking water at school. >> it's scary. it's it's, it's enraging, but it's also not something that comes as too much of a surprise. >> in april, ousd started testing different water sources at schools. of the hundreds of water sources tested in the spring, about 7% came back with levels of lead higher than considered safe. though parents and teachers say they were not

made aware until school started this fall. >> what is a surprise is that ousd knew about it in april, when they tested all the schools, and they didn't let us know until the beginning of the school year, and they didn't have a plan at the meeting, superintendent kayla johnson trammell calling it a failure on multiple levels. >> the delayed communication of the lead test results was completely unacceptable. i sincerely apologize for the stress and concern this has caused our school sites, students, and families. we understand the gravity of this situation. we are taking full accountability, including a full personnel investigation for these shortcomings, and are determined to ensure that such failures do not occur in the future. at the meeting, the district blamed aging infrastructure for the lead levels and said it would cost more than $38 million to fix and replace old pipes. >> they say they don't have the

budget for that, so they'll turn to the state and federal government for help. a guidance counselor at frich elementary says ousd is not doing enough to find an immediate fix, and instead that the staff is left to their own devices. we had one flow station, which over heated, i guess, and stopped working, and the kids had literally no water to drink. >> people have been donating water, bottles of water and our network superintendent brought in water in big containers and it's been hot. >> the district says this is an all hands on deck situation. they will have a comprehensive testing schedule available next month in the meantime, they say that they have ordered more flow water fill stations and are installing them as they get delivered. back to you. >> bailey o'carroll, thank you for that report. well, governor newsom's office is sharing its monthly update on the chp's ongoing crackdown in oakland. six months into the surge operation. we are told chp

officers have made about 800 arrests recovered, more than 1600 stolen vehicles and seized 81 illegal guns last month. governor newsom announced he was quadrupling the number of chp officers deployed in oakland through november. >> the santa clara county coroner's office has identified the woman killed in a wrong-way crash on highway 85. it happened monday afternoon near santa teresa boulevard, 47 year old rebecca joanne olson of san jose was driving in the northbound lanes with her 14 year old son. they were both killed when a speeding pickup truck slammed head on into their vehicle. at last check, the driver of the truck, duncan mcquarrie of florida, is still in the hospital. the sacramento family can now find closure after a man's body has been identified. 23 years after it was discovered in solano county. craig william oates body was found in the water at ryer island in march of 2001. in july of last year, solano county launched the john

this morning in the area of c street and watkins. police say the man was stabbed multiple times. his identity is being withheld at this time. this is hayward's 11th homicide of the year. >> the suspect accused of shooting and killing a man at a berkeley homeless shelter is now being charged with murder with hate crime enhancements. mark dowling, who was staying in the ursula sherman village in berkeley, had previously fought with the victim, his bunkmate marcel jones. witnesses say jones got into a fight with dowling over loud music, prompting dowling to shoot jones several times. he was arrested monday a few blocks away from the shelter. it's unclear what prompted the district attorney to add that hate crime enhancement now to contra costa county, where a small business in concord is turning to social media all in an effort to deter shoplifters. as our crime reporter henry lee shows us, the business is posting surveillance video of thieves on tiktok and some videos are going viral. >> we did decide to blur the faces of the people shown in

say while the street looks peaceful during the daytime, at night, it's another story. neighbors have photos showing what they say are sex workers, drunks and people urinating in public. now, some of those neighbors have banded together and filed a lawsuit tuesday against the city. >> i'm going to go into the specifics. the main point that we're claiming, and we were contending is that there are laws on the books, and if anybody had done what the city is doing, they would be in deep trouble. >> the lawsuit says, in part, that the city acted unlawfully by permitting prostitution and solicitation to occur on shotwell, and that the city failed in its duty to maintain safe conditions on the city's streets. neighbors say they've complained for years and haven't seen any real action. >> it's like the dog and pony show, and with the city, with the prostitution, with the johns, with the pimps. everybody. right. the city attorney's office released a short statement in response saying, quote, once we are served with the lawsuit, we will review the complaint and respond

appropriately. >> today, the mayor's office and supervisor hillary ronen, unveiled a new plan to address prostitution in the area. the plan calls for new barriers similar to those that were installed on capp street to curb prostitution there. cameras to deter sex work in the area and letters to the registered owners of cars that cruised the area looking for sex workers. and the city says it will continue to have uniformed and plainclothes officers working on prostitution enforcement. neighbors say they've heard promises that the issue would be resolved before, but are waiting for real results. for them, that means being able to not feel like prisoners in their own homes. >> they can move about if they want to move about during the evenings. they can move about during the evenings. >> sfpd say they've made 72 arrests in the area for various violations in the last four months. at this time, there's no timeline on when those barriers and cameras will go into place, and no timeline on when this case could see the inside of a courtroom in san francisco. christien kafton ktvu fox two news. >> burglary charges have been

dropped against a man formally charged in the deadly shooting of oakland police officer twan lay. 35 year old marquis cooper was initially charged with one count of murder and two counts of commercial burglary. the charges are in connection with the fatal shooting of officer lay, who was responding to a burglary at a cannabis dispensary last december. three other men are still facing murder charges. district attorney pamela price said both the murder charge and burglary charges have been dropped against cooper. >> the court at the preliminary hearing found that there was insufficient evidence to tie him to the murder charges, and so he was facing burglary charges. those charges were dismissed today without prejudice, and the investigation of his role and his conduct is continuing. >> the da would not comment on whether marquis cooper has struck a deal to cooperate with prosecutors or signed a plea agreement. cooper's attorney tells ktvu, quote, marquis and his family look forward to

having him home soon. in a statement, the oakland police officers association said it is concerned by the decision to drop charges against marquis cooper. the group said, quote, perpetrators of violent crimes must face consequences. otherwise, it sends a dangerous message that undermines public safety and emboldens those who threaten the peace and security of our neighborhoods. >> tonight in san jose, family and friends coming together to say goodbye to long pham. the san jose community service officer, who was killed in the line of duty on august 3rd. >> pham is the first cso to die on the job here in california. ktvu is an rubin has the story. >> with officers standing watch, people came to pay their respects to long pham. pham. a community service officer with san jose police had his life cut short on august third. he'd been doing traffic control when he was killed by a drunk driver. >> he's the sweetest guy you ever meet. honestly, if you need anything, he'll come help you
